Caisse des Dépôts is not authorised to regulate disputes between parties, whatever they may be. Neither can it receive voluntary consignments. You cannot deposit your rent or your expenses of your own accord: any consignments must be planned for by a legislative or regulatory measure, or ordered by a judicial or administrative ruling (article L 518-17 of the French Monetary and Financial Code) The départemental conciliation commission can be called upon to settle the dispute.

If the parties have not been able to reach an agreement, the judge of the district court may allow you to deposit your rent.

Caisse des Dépôts is not authorised to settle disputes between parties. On this regard, Article L 518-17 of the French Monetary and Financial Code only authorises the consignment of contested amounts pursuant to a judicial ruling. Consignment is only possible therefore if it is authorised by a judge.

That said, before considering consignment as an option, you can try to find an amicable solution with your property manager, if necessary, by calling on a third party. For that, you can give conciliation a go by contacting a judicial conciliator. For judicial conciliators' contact details, get in touch with your nearest district court or your municipal hall or police station.

If the amicable solutions reached are not what you hoped for, you can ask for a fund consignment from the competent judge pending the settlement of the dispute. It is advised to call in the other party in the procedure, or your request could be rejected.

If you would like the other party to provide a service or fulfil an obligation, before considering the consignment option it would be in your interests to use the prescriptive order procedure (Article 1425-1 to 9 of the French Civil Procedure Code): the aim of this procedure is to swiftly obtain fulfilment of a contract.

The role of consignments is to keep the amounts and securities which are entrusted.

Consignments offer a simple and effective protection service for the rights of natural and legal persons. Consignment consists of receiving and keeping amounts or securities due to a creditor, who is not able or does not want to receive them. It can only apply to cash or securities. The modalities are defined by a text (legal or regulatory), an administrative decision, or even a judicial decision.

It applies to very diverse areas: legal disputes, unclaimed assets, environmental financial guarantee, etc. There are over 160 cases of consignments. Moreover, until they reach adulthood, the Paris consignments agency keeps the earnings of children who work in shows or modelling. http://consignations.caissedesdepots.fr/

The French law of 13 June 2014 coming into force on 01 January 2016, defined the rules to qualify an account as dormant. The dormancy of an account depends on several criteria :

- If it is a current account (deposit account, sight account) or a savings product (Livret A, LDD, Plan Epargne Entreprise, etc.)

- If the account holder is alive or deceased

- If the account holder has kept in contact with the financial establishment.

Current account :

For 12 months, 2 cumulative conditions must be met for the account to be qualified as dormant:

- No activity in the account (management fees are not considered as activity)

and

- No communication on the part of the account holder with the bank for this account or for another open account under the same name in the same bank.

The account is declared dormant in the bank, which holds it for you for 10 years.

Plan d'épargne, Livret d'épargne or Plan d'épargne entreprise (Livret A, Livret de Développement Durable, etc.) :

For 5 years, 2 cumulative conditions must be met for the savings product to be qualified as dormant:   on annonce 2 conditions et il n’y en a qu’une en français aussi : ?

- No activity in the account (management fees are not considered as activity)

N.B.: If the savings product has been blocked for a certain period of time, the dormancy of the product begins at the end of the unavailability period, in other words, from the moment the sums become available to the holder.

The account holder is deceased

The account is qualified as dormant when, for a 12 month period after the death of the holder, the beneficiary holders have not informed the financial establishment of their desire to exercise their rights.

The account is declared dormant in the financial establishment, which holds it for the beneficiaries for 3 years.

After a certain time period without any activity or communication from the holder, the financial institution will, between July and December 2016, send the money from dormant accounts to Caisse des Dépôts.

The French law of 13 June 2014, taking effect on 01 January 2016, defined the rules for qualifying a life-insurance contract as unclaimed.

The inactivity of a contract depends on several criteria:

- Is the policyholder alive or deceased?

- Has the policyholder kept in contact with the insurance body?

The policyholder is alive

A life insurance contract is considered as unclaimed if the contract has reached its term and if the capital has not been claimed by the policyholder or the beneficiary/beneficiaries.

This contract is declared unclaimed by the insurance body. The insurance body keep it for 10 years.

The policyholder is deceased

A life insurance contract is considered as unclaimed as soon as the insurance body becomes aware of the date of the policyholder’s death.

This life insurance contract is declared as unclaimed by the insurance body. The insurance body keep it for 10 years.

For life insurance contracts with a policyholder who has been deceased for less than 10 years, the Association for the management of information on insurance risk (AGIRA) considers information requests from all insurance bodies. This request must be made via mail to: http://www.agira.asso.fr/content/comment-saisir-lagira
