Caisse des Dépôts a founder member of the Association française des fiduciaires

The Association française des fiduciaires (the French Association of the Fiduciary Companies - AFF), a non-profit association, was launched at the beginning of February by its three founder members: Caisse des Dépôts, Crédit Agricole CIB and the Equitis Gestion trust company.
This initiative aims to bring together the professionals concerned by this recent provision of French law. The ambition of the Association Française des Fiduciaires (AFF), which is currently being constituted, is not only to coordinate the research, thinking and activities of its members but also to encourage sharing of best fiduciary practices. For this purpose, it plans to draw up a charter of good conduct which would apply in particular to all of its members. The AFF also aims to promote the development of fiduciary activity and represent the fiduciary profession in dealings with the administration and public authorities or other regulated professions.
Chairmanship of the AFF is entrusted to Stéphan Catoire, assisted by Denis Henrion, managing director of Equitis Gestion, as Secretary General and Treasurer.
The AFF has a scientific committee whose members are appointed by the Board of Directors. It proposes themes for thinking and research to the Association’s members and supervises the drafting and publication of the Association’s works, which will shortly be available on a website.
Caisse des Dépôts’ involvement in the Association testifies to its desire to promote and support the development of fiduciary trust to make it a competitive tool in the Paris financial and legal market. “We thought it was important to get involved in the Association to demonstrate our desire to promote fiduciary trust and the expertise of the Paris market in a practice destined to develop strongly”, states Nathalie Gilly.
La fiducie
La fiducie est un dispositif juridique entré en vigueur en France en 2007 qui se définit comme l’opération par laquelle un constituant transfère des biens, des droits ou des sûretés à un fiduciaire, qui les tenant séparés de son patrimoine propre, agit dans un but déterminé au profit d’un ou plusieurs bénéficiaires.
Permettant d’isoler un patrimoine dédié à une finalité déterminée, elle apparaît comme un outil de sécurisation des transactions particulièrement efficace et adaptable à un très grand nombre de situations.
